In accordance with Article 1 of the Law "On Access to Public Information", public information is the information, represented and documented by any means and on any storage media, which was received or created during the duty execution by the authority subjects, in conformity with the current legislation or which is in the possession of the subjects of power authorities, other administrators of public information, determined by this law.
Part 2 of this Article states that public information is open, excepting the cases specified by law.
In accordance with Article 12 of the Law of Ukraine "On Access to Public Information" of 13.01.2011, No. 2939-VI, applicants for information are individuals, legal persons, associations of citizens without the status of a legal entity, excepting the subjects of authority.
To make request for information
In order to submit a request for public information, citizens can apply to the Ukrainian Institute for Plant Variety Examination on a daily basis, excepting weekends and holidays, from 9:00 to 18:00 (Friday and before holiday days to 16:45), a break from 13:00 to 13:45.
The request for information may be individual or collective. Requests may be submitted orally or in written form (by mail, fax, telephone, e-mail).
To submit a request for information by mail, it is necessary to send the letter to the address: 15 Henerala Rodymtseva Str., Kyiv, 03041, Ukraine and specify the addressee - Ukrainian Institute for Plant Variety Examination or UIPVE Director.

Written request doesn’t require a special form.
The request for information should include:
1) the name (denomination) of the requestor, postal address or e-mail address, as well as the number of the mean of communication, if any;
2) a general description of the needed information or the type, title, details or contents of the document in respect of which the request is made, if it is known to the requested party;
3) signature and date, in case of submitting in written form.
An official reply goes back within five working days of the date the request for information is received.
If the request for information relates to the necessity to protect the life or freedom of a person, concerning the state of the environment, the quality of food and household items, accidents, disasters, natural hazards and other emergencies that have occurred or may occur and endanger the safety of citizens, the reply must be done no later than 48 hours from the date of the request reception. The application for the request urgent processing must be substantiated.
If the request relates to the large amount of information provision or requires the information search in a large amount of data, the information administrator may prolong the term of request processing up to 20 days justifying such a prolongation. In case of such a prolongation administrator informs the applicant in written form not later than five working days from the date of the request reception.
Appeal proceedings against decisions, actions or inactivity of the information administrator related to access to public information
According to the Law "On Access to Public Information", a reply to a request for information must be given no later than five working days from the date the request reception. If the request relates to the provision of a large amount of information or if it requires the search in a large amount of data, the period for reviewing the request may be extended to 20 working days with substantiation for such extension.
In accordance with Article 23 of the Law "On Access to Public Information", decisions, actions or inactivity of the information administrator may be appealed to director, higher authority or a court.
Appeals against decisions, actions or inactivity of information administrators to court proceed in accordance with the Code of Administrative Justice of Ukraine.
